VISA ASSISTANCE CONDITIONS
The company BG AIR SERVICES PVT LTD concludes with the CLIENT (VISA APPLICANT), to offer VISA HANDLING SERVICES which shall be subject to these general terms and conditions, while matters which are not provided for in these general terms and conditions shall be governed by the laws, ordinances, regulations and generally established practice of Sri Lanka;
The visa handling services as stated in these general terms and conditions means the services offered by the BG AIR SERVICES PVT LTD on an explicit verbal or written authorization given by the CLIENT, whereas the CLIENT is reasoned with intent to travel overseas; upon receiving such authorization the company shall undertake to collect from the CLIENT the necessary documentation needed for the visa application, with no liability whatsoever for the content of the documentation provided by the CLIENT;
The CLIENT shall supply BG AIR SERVICES PVT LTD with all the useful information that is expressly requested for processing his/her visa application. Should the CLIENT supply intentionally or unintentionally any wrong information and in the event BG AIR SERVICES PVT LTD discovers the same BG AIR SERVICES PVT LTD reserves the right to NOT PROCESS the said visa application and to recover any additional costs incurred for processing the visa application;
The CLIENT is the legally responsible person for all information provided to BG AIR SERVICES PVT LTD for processing his/her visa application. The general terms and conditions stipulate that the CLIENT exonerates BG AIR SERVICES PVT LTD from any legal liability for his/her actions now or in future, that may give rise to any foreseen and/or unforeseen issues, with reference to processing a visa application and shall keep BG AIR SERVICES (PVT) LTD indemnified against any fines, penalties, damages, and losses caused;
BG AIR SERVICES PVT LTD shall not accept any responsibility or liability and holds no legal bonding with the CLIENT other than the understanding to provide visa handling services; BG AIR SERVICES PVT LTD shall not be liable to pay compensation nor represent the CLIENT in matters of legal nature or similar within the legal framework of Sri Lanka or that of beyond the shores of Sri Lanka;
BG AIR SERVICES PVT LTD shall not take any responsibility to verify the authenticity of the documentation submitted by the CLIENT; as such complete obligation for the authenticity of any documentation provided shall exclusively remain the legal responsibility of the CLIENT and the CLIENT shall indemnify the BG AIR SERVICES (PVT) LTD in respect of the same;
The CLIENT takes responsibility to provide all the necessary documentation to BG AIR SERVICES PVT LTD within a reasonable time frame, verbally agreed between the CLIENT and BG AIR SERVICES PVT LTD; BG AIR SERVICES PVT LTD shall not be liable for delays arising in processing visa applications, owing to the CLIENT not submitting all the necessary documentation to BG AIR SERVICES PVT LTD office on time;
At the start of this process, BG AIR SERVICES PVT LTD shall produce an invoice for which the CLIENT is legally obliged to make the payment before commencing with the services. In case the CLIENT fails to make the said payment, then BG AIR SERVICES PVT LTD reserves the right to deny the service to the CLIENT. In the case of CORPORATE CLIENTS, purchase order and/or acknowledgment receipt on the part of the CLIENT is mandatory to proceed with the services, failing which BG AIR SERVICES PVT LTD reserves the right to deny the service to the CLIENT.
REFUND / CANCELLATION POLICY
Subject to the following conditions:
- All the necessary steps have been taken to prepare the visa application documentation which is ready for submission to the Embassy but at this stage, the CLIENT withdraws the visa request. In such a case only the visa fee will be refunded; the document handling fee is retained by BG AIR SERVICES PVT LTD.
- The application had already been processed online for an e-Visa but the CLIENT decides to withdraw the request. In such case document handling fee + visa fee is non-refundable;
- The passport along with the visa application had already been submitted to the Embassy but the CLIENT decides to withdraw the request. In such case document handling fee + visa fee is non-refundable;
The company shall do its utmost to provide the CLIENT with the services required to have a positive outcome on the visa but shall not guarantee any applicant of the visa been issued, with due respect to the norms prevailing by the respective Embassies / High Commissions / Consulates. It is understood that the final decision for issuance or denial of a visa remains with the respective Diplomatic Mission.
